Non-occupancy charges apply to paying guests too
A one-paragraph corrigendum of 25 February 2011 to the non-occupancy charges order of 2001, making it clear that the 10% limit covers flats occupied by paying guests.
Key points
- The 2001 order did not mention paying guests.
- The corrigendum adds to point 2 of that order: “this includes paying guests as well”.
- So a society may levy non-occupancy charges on a flat let to paying guests, within the same limit of 10% of service charges.
What the corrigendum says
The order of 01.08.2001 provided that non-occupancy charges must not exceed 10% of the service charges, but it did not use the words “paying guest”. To include paying guests, the Government approved this corrigendum, which adds after “must not exceed 10%” in point 2 of the 2001 order the words: “this applies to paying guests as well”.
The corrigendum was sent to the Commissioner for Co-operation, all Divisional Joint Registrars and District Deputy Registrars, and to the State Information Commission in connection with an appeal before it.
What it means in practice
A member who keeps paying guests is treated like a member who has let the flat. The society may levy a non-occupancy charge, but not more than 10% of the service charges, and the close-relatives exemption of the 2001 order continues to apply.
