SRA Circular 218: which approvals are delegated to the Secretary and the Deputy Chief Engineer
SRA Circular No. 218 of 5 April 2024, issued on a representation by CREDAI-MCHI, delegates several approvals in slum rehabilitation schemes to the Secretary, SRA and the Deputy Chief Engineer to speed up schemes.
Key points
- Approval of a new developer where an order under Section 13(2) of the Slum Act has been passed: Secretary, SRA.
- Hearings under Section 13(2) where a developer fails to implement an accepted scheme, on the request of slum dwellers or the society or suo motu: Secretary, SRA.
- Deferment facility proposals up to ₹5 crore: Secretary, SRA. Revisions of the LOI with up to 10% more FSI, and miscellaneous proposals (site office, labour camps, transit camps): Deputy Chief Engineer.
- The Estate Department works under the direct control of the Secretary, SRA.
Background
CREDAI-MCHI represented on 26.02.2024 that the working of the SRA’s Estate and Co-operative departments needed streamlining, and made suggestions — on rent deposits under Circular 210, quicker action under Sections 33, 33A and 38 of the Slum Act, the lottery procedure, the appeal process, and the defect liability condition introduced by Circular 216. The Secretary, Deputy Chief Engineer, Chief Legal Consultant and Finance Controller considered them; some (auto Annexure-II, Auto DCR) were already being implemented.
What the circular directs
Using the CEO’s powers under Section 3(5) of the Slum Act, 1971, with immediate effect:
- In schemes where a Section 13(2) order has been passed, the proposal to accept a new developer is approved by the Secretary, SRA.
- Where a scheme has only been accepted and the developer fails to implement it within a reasonable period, a Section 13(2) hearing may be held by the Secretary, SRA, on request of the slum dwellers or society, or on its own.
- Deferment facility proposals up to ₹5 crore are approved by the Secretary, SRA.
- After the CEO approves the LOI, further approvals — including revision of the LOI with an increase of up to 10% of the sanctioned FSI, and changes within DCPR 2034 — are approved by the Deputy Chief Engineer.
- Miscellaneous proposals such as temporary or site offices, labour camps and transit camps are approved by the Deputy Chief Engineer.
- The Estate Department works under the direct supervision and control of the Secretary, SRA.
What it means for slum dwellers’ societies
A society whose developer has stalled can ask the Secretary, SRA for a Section 13(2) hearing, and a change of developer is decided at that level, which should be quicker than going to the CEO.
